Sony sinks to $199 mln quarterly loss on disaster (AP)

TOKYO ? Sony Corp. sank to a 15.5 billion yen ($199 million) quarterly loss, hurt by the disasters in northeastern Japan, a massive online security breach and plunging TV prices.

The Tokyo-based electronics and entertainment company said Thursday it had lowered its profit forecast for the fiscal year ending March 2012 to 60 billion yen ($769 million) from 80 billion yen ($1 billion) it gave in May.

But that would still mark a return to profit for the maker of the PlayStation 3 game console, Bravia TVs and Vaio laptops after three straight years of red ink.

Sony posted a 25.7 billion yen profit in the April-June period of 2010.

It said business operations hurt by the March 11 earthquake and tsunami were recovering quicker than initially expected, but it suffered net charges of 700 million yen ($8 million) in repairs, cleaning costs, damages to buildings and assets and other expenses.

Sony acknowledged the cyber attacks on its network services had forced a temporary shut down. The PlayStation Network and other services were restored earlier this month in all countries.

The global security breach affected more than 100 million online accounts. Sony has said it will book a special charge of 14 billion yen ($179 million) to cover costs of customer support, freebie packages, legal costs, lower sales and measures to beef up security during the current fiscal year.

Sony also lowered its sales forecast for the fiscal year ending March 2012 to 7.2 trillion yen ($92 billion) from 7.5 trillion yen ($96 billion). But that's still better than sales of 7.18 trillion yen in the previous year.

It blamed the reduced forecast on lower sales of flat-panel TVs, plunging prices and the strengthening of the yen against the dollar, which is hammering Japanese exporters.

The company has lost money for seven straight years in its important TV business, but has vowed to be back in the black this fiscal year. The TV division remained in the red for the April-June period.

Sony was once the star in electronics products like TVs and digital players, but in recent years has lost its luster in the face of rivals, including Samsung Electronics Co., from which Sony buys liquid crystal displays for its TVs, and Apple Inc., with its iPod, which quickly made the Walkman obsolete.

Sales for April-June slipped 5 percent to 1.49 trillion yen ($19 billion).

Its motion pictures division got a perk from the home entertainment release of popular films from the previous year such as "The Green Hornet" and "Battle: Los Angeles."

Helping lift sales in its music division were Adele's "21" and Beyonce's "4" recording releases. Music from the hit TV show "Glee" was also a strong seller, according to Sony.

Sony stock closed at 2,013 yen, down 1 percent, in Tokyo. Earnings were announced shortly after trading ended in Tokyo.

His view is that the most important part is to be honest about what you want and need, and to express that openly with your partner. He believes that couples can, and basically should, get beyond affairs. He feels that straight marriages should model themselves on long term gay relationships which frequently include extramarital relationships. He states that monogamy is just one aspect of marriage and that the priority should or could be on joy or humor rather than fidelity.

In my job at the Center I have certainly seen that infidelity can improve a couple?s sex life. I have seen women who had waning desire for their husbands skyrocket once they find out about an affair. TVGuide.com: Now that some time has passed, how do you feel about the Season 3 finale?
Bruno Heller: I was very pleased. Bradley Whitford is a fine actor and gave a nice, creepy, solid performance. I hope the audience out there was pleased with it. Certainly, it throws a big stone in the pond. Coming into this period in the show, you want to shake things up a little.

TVGuide.com: How did you land on Bradley Whitford for the part? He's not necessarily the go-to guy for serial killer roles.
Heller: It was a tricky part because you need someone who's both powerful and charismatic, but to some degree very normal ? just a regular guy. And [Bradley's] wonderful at playing a regular guy. I don't think he's ever been used in that way before, as a villain of that magnitude. It was great fun for him to play someone like that.

TVGuide.com: You've often said Red John is Patrick Jane's "white whale." Was it a challenge to write the episode where Jane gets his guy?
Heller: Writing that episode was not a challenge. Writing this next episode is the challenge. [Laughs] But that's exactly what you want: a challenge and an interesting dramatic corner to write one's way out of. And I think we've definitely done that. I think the challenge is moving the story forward without making the audience feel that they've been betrayed or conned or led astray. And I'm fairly confident ? as confident as one can be ? that they will not feel that way.

TVGuide.com: I assume you're speaking of the people who have already decided that Bradley Whitford isn't really Red John?
Heller: Jane, in that scene, is kind of suspicious and dubious. The audience is in the same position as Jane. But Jane believes that this is Red John.

TVGuide.com: Either way, how will the new season deal with the fact that Jane murdered a man?
Heller: He is arrested for murder. Jane correctly says, "This guy said he was Red John, and he held a gun on me. It was self-defense." But the police reply that... no gun was found. So, within five minutes of the season opener, Jane is in jail for homicide with no way out, apparently. The immediate problem is not so much, "Is Red John alive or dead?" but, "How the hell am I going to get out from under a death sentence?"

TVGuide.com: Will Lisbon (Robin Tunney) or any of Jane's teammates be able to help?
Heller: He has to rely on them to get him out of that mess. And then the question does become: Are these temporary friends, or is there a deeper bond there? ... Also, [Jane] and Lisbon, to some extent, start questioning his sanity. He swears there was a gun, and this guy said he was Red John, but there is no proof.

TVGuide.com: But the audience saw the gun. So, is someone still following Red John's orders?
Heller: An intelligent viewer might think so.

TVGuide.com: Does the murder change Jane as a character? Are you worried audiences will be turned off by his actions?
Heller: Through all of that charm and joie de vivre, there is a certain steely hardness about him. There has always been an edge to him, and I think that is something the audience has always been able to see. If they didn't see it before, they're certainly seeing it now. I think, certainly in the first year, people might not have been willing to accept that kind of merciless streak in his character, but I hope they will come along with it now.

TVGuide.com: Will he keep that edge all season, or will we still see some of the fun-loving Jane we've gotten to know?
Heller: The latter. It's always a balance. When Jane sees a boundary or an edge, he wants to see how far he can press it. But we're never going to put the show in a place where people are pushed away by its edginess. For good or ill, it's always been a show that you can watch with your grandmother and your child, and we very much want to keep it that way. But, you know, grandmothers like edge and children like edge.

TVGuide.com: How much does that finale change the show for you?
Heller: Every season you kind of take a chance to reset things. ... Last season was almost serialized. There was a great deal of plot and story that you could follow through the whole season. We're going to need less of that this season. There still will be an overarching narrative going on, but it won't be quite so intricate. From Jane's point of view, he doesn't want to play games any more. [He wants] to pull back a bit from that kind of obsessive chase, because it's the obsessive chase that has gotten him into problems in the first place,.

TVGuide.com: But if Jane really did kill Red John, what does the next chapter of the show look like?
Helller: If you got your heart's desire, and your heart's desire was a kind of bitter and dangerous pill to swallow, how would you go on with the rest of your life? What does revenge mean? Because, as you saw in that final moment, after you've killed someone, what's left? It's not like love. Love makes things grow. That kind of bitterness and hate kills things. But then, what do you do? That's what the show would be about when Red John is dead.

The repercussions from the phone-hacking done by News Corp (NSDQ: NWS). journalists and executives are piling up so fast it?s hard to keep track. In addition to the public loss of face and obvious ethical implications, the real and potential legal consequences are mounting.

As part of its early efforts to one day get a fresh start, News Corp. is already hiring outside firms to help it out. That includes legal talent from Williams & Connolly. As NYT?s DealBook reports today, that?s a departure from its usual go-to law firms.

Here?s a list of the legal fallout thus far:

?? British police have arrested seven people thus far in connection with the phone hacking scandal; and two others were arrested because they are believed to be involved in the bribing of police officers, according to a report today from The Associated Press.

?? Prime Minister David Cameron has appointed a judge to oversee a criminal inquiry into the phone hacking activities at News of the World and elsewhere. Deposed News Corp. executive Rebekah Brooks, along with both Murdochs, have agreed to testify before a committee in Parliament next week.

?? Attorneys representing actor Jude Law filed a lawsuit today against The Sun, another News Corp. owned tabloid, saying the newspaper?s employees illegally hacked his phone. Law already has a lawsuit going against News of the World; his former fiancee Sienna Miller has already received ?100,000 and an apology from NOTW.

?? Law wasn?t the only actor filing suits today. British actor Hugh Grant is suing the London Metropolitan Police; according to the report in Bloomberg, that?s a strategy that some possible victims are pursuing to get any evidence the police have about whether their phones were accessed or not. In April, Grant published a transcript of a conversation he had with an ex-NOTW journalist in the New Statesman, in which the journalist said that phone hacking was common practice.

?? Senior execs at News of the World are alleged to have bribed British police in order to get phone numbers for members of the royal family. As noted above, there have already been two arrests related to this allegation.

?? A few big News Corp. shareholders, including Amalgamated Bank and Central Laborers? Pension Funds, have already filed shareholder lawsuits against Murdoch, saying he ran the company in an irresponsible way. More such lawsuits are probably on the way. Even though shareholder lawsuits don?t necessarily amount to much?they can and are filed over practically anything that makes a company?s stock go down?such allegations have a big lift when there?s a real, and well-publicized, scandal behind them.

(It?s worth noting that these shareholders already had lawsuits underway, as The Telegraph reported last night; in March, they filed a lawsuit arguing that News Corp.?s ?415m purchase of his Murdoch?s daughter?s TV company was a case of ?rampant nepotism.? Now that the NOTW phone-hacking scandal is breaking, they?re adding additional allegations to the suit.)

And in the U.S. ...

?? The FBI is considering an investigation against News Corp. It will mostly hinge on whether any of the hacking activities occurred in the U.S. Among the groups who are upset: families of Sept. 11 victims, who believe that British tabloid reporters may have hacked into victims? cell phones.

The first reports of FBI interest came out from anonymous leaks early this week, but today U.S. Attorney General Eric Holder confirmed that a federal investigation is underway. Members of Congress asked him to open the investigation, Holder said.

?? One criminal charge which really might not be a stretch: anti-bribery charges. As any white-collar defense lawyer can tell you, the feds have stepped up enforcement of the Foreign Corrupt Practices Act, or FCPA, in recent years. That law bars companies that do business in the U.S. from bribing foreign officials. A ProPublica story considering the FCPA ramifications of this whole business notes that News of the World reporters are alleged to have paid British cops $160,000 in total.

?? And there?s also been talk of Congress asking the Murdochs or other News Corp. execs for answers directly. Rep. John Conyers (D-Michigan), a senior lawmaker on the House Judiciary Committee, released a statement noting that News of the World, ?which maintained a bureau in Hollywood, had for years illegally intercepted the voicemail messages of private individuals residing in the United States,? Conyers added.

China almost doubles rare earth export quota (AFP)

BEIJING (AFP) ? China on Thursday nearly doubled the export quota of rare earths for the second half of the year to 15,738 tonnes, amid tensions with trade partners over its grip on the shipments of raw materials.

The quota for the next six months of the year is up 97.3 percent from the 7,976 tonnes set for the same period last year, according to data from the Ministry of Commerce.

China produces more than 95 percent of the world's rare earths -- 17 elements critical to manufacturing everything from iPods to low-emission cars and missiles.

But Beijing has angered trade partners by restricting overseas shipments of rare earths, in a bid to burnish its green credentials and tighten its grip over the sought-after metals.

In December, it slashed the export quota of the metals for the first half of the year to around 14,450 tonnes, down 35 percent from the same period in 2010, after cutting the maximum by 72 percent for the second half of 2009.

The moves have led to a spike in international prices of the elements and triggered mounting complaints from foreign buyers.

The European Union on Thursday criticised the new quota, saying there was actually "no noticeable change in the annual amount of rare earths China will allow to be exported to the EU."

John Clancy, EU trade spokesman, said the new measure now covered iron alloys containing rare earths, which he said resulted in a "tightening of the quota" in practical terms.

"This is highly disappointing and the EU continues to encourage the Chinese authorities to revisit their export restrictions policy to ensure there is full, fair, predictable and non-discriminatory access to rare earth supplies."

Last week, the World Trade Organization ruled against China's export restrictions on some other raw materials than the metals.

EU trade commissioner Karel De Gucht -- who met Chinese commerce minister Chen Deming on Thursday to discuss a range of issues including rare earths -- told reporters that China would appeal the decision.

"The Chinese made it clear they are going to appeal... but if the appellate body were to confirm this decision they would take measures to live up to it," De Gucht said.

If China were to lose the WTO appeal "they realise this will have an effect on (their rare earths policy) and we have very clearly stated that we prefer to come to a negotiated solution."

The WTO upheld complaints by the United States, the European Union and Mexico that Beijing had restricted exports of industrial raw materials such as bauxite, coke, fluorspar, magnesium and manganese to help its own industries against foreign competitors.

The commerce ministry would not confirm the appeal when contacted by AFP.

Industrials could signal slower growth ahead (Reuters)

NEW YORK (Reuters) ? U.S. manufacturers are entering an period where growth is more muted, profit margins are harder to raise and earnings beats are less common.

The easy money has been made, many analysts and shareholders of U.S. industrial stocks say.

General Electric Co's (GE.N) Jeff Immelt, whose company reports second-quarter earnings next week, acknowledges that the industrial conglomerate is operating in volatile times.

Demand is tremendous, the company's chief executive says. "You see it getting better, yet at the same time, there's more discontent," Immelt said this week at a sprawling GE factory in South Carolina. "This recovery has been so different from previous recoveries."

Analysts say industrials are in transition from a

"V-shaped" recovery after recession, when nearly everyone increased sales and profits, to an unpredictable period when some businesses thrive, others lag and picking winners is harder.

"Industrials as a group may be among the first to see their profit margins challenged," said Keith Goddard, manager of the Capital Advisors Growth Fund, which owns GE, Johnson Controls (JCI.N) and FedEx (FDX.N), among other companies whose fortunes are tied to the business cycle.

"Margins are bumping up against all-time highs," said Goddard, who favors healthcare stocks. "Don't go to the industrial space looking for positive earnings surprises."

Increasing commodity and labor costs will trim profits across corporate America, he said, hitting labor-intensive manufacturers. GE has more than 100,000 workers just in the United States.

Many investors play down the negative effects of the U.S. government debt-ceiling impasse and a cautious, debt-burdened U.S. consumer. Slow growth is not a double-dip recession, they say.

Although the U.S. recovery has stalled by some measures, other large economies are still hungry for heavy machinery, cooling equipment, tools and other industrial goods.

Companies keyed to Brazil, India and China, including 3M (MMM.N), Eaton Corp (ETN.N) and Emerson Electric Co (EMR.N), will again benefit from robust capital spending, much of it funded by governments.

One question earnings season may answer is whether Europe's debt crisis will affect growth and alter profit expectations. Europe's problems are overemphasized, said Oliver Pursche, co-manager of the GMG Defensive Beta Fund, which holds shares of Caterpillar (CAT.N), Deere (DE.N) and United Technologies (UTX.N).

"I'm not too worried about earnings this quarter," Pursche said -- but a potential global economic slowdown could damp prospects for corporate profits. "I'm much more concerned about cautionary statements from CFOs and CEOs about the rest of the year. It's going to be a much more challenging environment."

Caterpillar could sound a cautious note because of China's efforts to rein in its economy, he said. China's leaders have suggested they will again raise interest rates and bank reserve requirements to bring down inflation.

STALLED RECOVERY

U.S. industrials are among the most globally diverse multinationals, but the U.S. market still accounts for as much as half of their revenue. Recent data offers fodder for both bulls and bears.

U.S. June industrial production data disappointed on Friday, and May was revised lower.

A monthly gauge of factory activity by the Institute of Supply Management rebounded last month from a May slump, easing fears of a broad slowdown.

But construction spending -- a key market for companies ranging from Eaton to Ingersoll Rand (IR.N), United Technologies and Tyco (TYC.N) -- has fallen for six straight months to its lowest in a decade.

And a quarterly Manufacturers Alliance/MAPI survey pointed to further growth, but at a slower rate. The poll of financial executives, a leading indicator of manufacturing activity, found a fourth straight decline in sentiment.

Companies whose fiscal years ended in June, including Parker Hannifin (PH.N) and Kennametal (KMT.N), will give initial glimpses into 2012 when they introduce 12-month earnings forecasts. Both are known for starting with conservative profit targets.

Other variables to watch this quarter are how much Japan's March earthquake hurts companies such as 3M; electrical manufacturers' ability to offset higher steel and copper costs with pricing; and the impact of a weak U.S. dollar.

Depressed housing and a delayed recovery in non-residential construction could hurt machinery makers and rental companies, as well as makers of air conditioners and components.

Other late-cycle markets, such as power generation equipment and aerospace, are also expected to grow over the next two years after declines in 2009 and 2010, so any sign of whether their rebound has begun will be an area of focus.

Electrical equipment and multi-industry companies are near the end of a beat-and-raise phase of their cycle, said Nomura analyst Shannon O'Callahan.

"You had the big V-shaped snapback against easy comparisons," he said. "Growth has been abnormally high. We're entering a maturing part of the cycle."

Managers will point to moderating growth rates this quarter, with few sounding especially bullish. Corporate crystal balls are as cloudy as anyone else's, O'Callahan said.

'WHITE-KNUCKLE' BULLS

Enough investors see the glass as half-full that earnings expectations and price-to-earnings ratios have risen this year. Industrial shares (.GSPIC) are up 7 percent year to date, outperforming the broader market. A few, such as Tyco and SPX (SPW.N), have jumped 25 percent or more.

At 16 times this year's estimated earnings, industrials are more richly valued than the overall S&P 500, but are only slightly above their historical average, according to Goldman Sachs.

Goldman analysts, in a July 10 note, predicted industrial companies would sound a more "constructive" tone about the second half of the year than recent economic numbers suggest. They cited expanding late-cycle markets, the weak dollar, and share buybacks and acquisitions.

Most U.S. industrials will beat Wall Street forecasts by 1 percent or 2 percent, said analyst Brian Langenberg of Langenberg & Co, who calls himself a "white-knuckle" bull.

"I expect bigger beats out of companies levered to energy," he said, citing Dover (DOV.N), Ametek (AME.N) and Emerson. "Ninety-some-dollar oil makes it worth punching holes in the ground."

Langenberg said current expectations of double-digit profit growth over the next two years are reasonable.

"We're not back at peak earnings yet," he said.

Users will find quadband GSM among the mix, but 3G support remains a mystery -- likewise for the RAM, internal storage, and battery capacity. Pricing is an unknown quantity too, although earlier reports suggest we'll see something in the range of RMB 1,600 (approximately $250). This potential KIRF'ers paradise is expected to ship between mid-August and early September in a variety of colors, which will be eclipsed only by the sweet smell of its unboxing.
